2. Warranty and Remedy

We at Sensorsoft Corporation strive to create high quality products. Although we test all products for proper functionality, we cannot guarantee that there will never be a defective unit, or that a device or software will function on all communication or computing equipment in existence. For this reason, it must be clear that the warrantors are not insuring your premises or guaranteeing that there will not be damage to your person or property if you use this product. If this warranty is unacceptable please return the product for a refund.

Two Year Limited Warranty - SENSORSOFT CORPORATION warrants its products to be free from defects in material and workmanship under normal use for two years, and is not responsible for consequential damage or installation costs of any nature. In the event that the product does not conform to this warranty at any time during the period of two years from the original purchase date, the warrantor will repair the defect and return it to you at no charge.

This warranty shall become null and void in the event that the product is 1) damaged by extraneous causes such as fire, water, lightning, etc. 2) not maintained in a reasonable and necessary manner, 3) modified, 4) improperly installed, 5) repaired by someone other than the warrantor, 6) used in a manner or purpose for which the product was not intended, and 7) showing signs of tampering or reverse engineering.

WARRANTOR'S OBLIGATION UNDER THIS WARRANTY IS LIMITED TO REPAIR OR REPLACEMENT OF THE PRODUCT ONLY. THIS WARRANTY DOES NOT COVER PAYMENT OR PROVIDE FOR THE REIMBURSEMENT OF PAYMENT FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

The warrantor shall not be liable, under any circumstances, for damage to your person or property or some other person or that person's property by reason of the sale or use of this product, or its failure to operate in the manner in which it is designed. Use of this product is at your own risk.

3. Procedures for obtaining performance for warranty:

In the event that the product does not conform to this warranty, the product should be shipped or delivered freight prepaid to the warrantor with evidence of original purchase. If in any way you are not comfortable with the product or its Limited Warranty, we encourage you to return it for a refund.

SENSORSOFT CORPORATION'S ENVIRONMENTAL SENSORS, RELAYS AND SOFTWARE ARE ONLY TO BE USED AS A MONITORING SYSTEM AND ARE NOT TO BE USED AS THE SOLE MONITOR OR WARNING SYSTEM OF ENVIRONMENTAL CONDITIONS.

IN NO WAY WILL SENSORSOFT CORPORATION BE RESPONSIBLE OR LIABLE FOR ANY LOSSES TO YOUR PERSON OR EQUIPMENT DUE TO THE FAILURE OF: (1) THE MOBILITY/COMMUNICATION SERVICE THE PURCHASER OR USER SUBSCRIBES TO; (2) FAILURE OF ANY PHONE/PAGING SERVICE, INCLUDING PHONE LINES, PAGERS, AND CELLULAR PHONES; (3) FAILURE OF ANY EQUIPMENT SUCH AS SERIAL PORTS, MODEMS, WIRING/CABLING, OTHER SOFTWARE OR PC'S.

SENSORSOFT TEMPERATURE SENSORS DO NOT DETECT SMOKE, AND SHOULD NEVER BE USED AS A FIRE ALARM. SENSORSOFT CORPORATION RECOMMENDS USING A FIRE ALARM TO SENSE A FIRE HAZARD.

UNDER NO CIRCUMSTANCES IS SENSORSOFT CORPORATION LIABLE FOR ANY OF THE FOLLOWING: (1) THIRD-PARTY CLAIMS AGAINST YOU FOR LOSSES OR DAMAGES; (2) LOSS OF, OR DAMAGE TO, YOUR RECORDS, DATA OR COMPUTER EQUIPMENT; OR (3) SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OR FOR ANY ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR SAVINGS).
